Simon Smith

Simon qualified as a solicitor in 1996 and has specialized in commercial litigation since. Simon previously worked in two medium sized regional firms and spent 9 years at one of the largest national firms. He joined Ironmonger Curtis as commercial litigation partner in 2008.
Simon covers a very wide range of business disputes from debt recovery to complex contractual, business and property disputes. His caseload varies from acting for individuals to PLC’s as well as a large number of small to medium sized businesses. Simon is very “hands on” and takes a pro active approach to both bringing and defending cases and will consider all available options in terms of commercial settlements, mediation, arbitration and court proceedings. Simon also deals with County and High Court jurisdictions and has had a number of cases referred to the Court of Appeal, including two reported cases.
Some of Simon’s recent work includes:
- Acting for a construction company in a property dispute with a local authority arising out of a Compulsory Purchase Order, obtaining in excess of £300,000 in damages.
- Acting for a manufacturing company against a former director for conspiring with employees to manufacture the company’s goods “on the cheap” and obtaining £60,000 in damages and costs.
- Acting for a number of companies in successfully defending claims for “passing off” based on alleged website infringements resulting in savings of in excess of £50,000.
- Acting for a husband and wife ornithologist partnership against Severn Trent Water Limited in a commercial contract dispute where the claim succeeded at County Court trial with an award of over £90,000 in damages, costs and interest.
- Acting for a manufacturing business in contract dispute claims in excess of £400,000 in the High Court in London.
