Dental Partnership AgreementsThe dental lawyers at Ironmonger Curtis LLP are experienced in all aspects of dental partnership agreements. The duties and liabilities of partners are governed by an agreement which exists between them and/or the Partnership Act 1890 (the Act). A partnership exists where persons carry on business in common with a view to a profit. No documentation is required to create a partnership and therefore you should exercise caution in your dealings with others so as to avoid forming a partnership inadvertently. It is always recommended to have a written dental partnership agreement to deal with issues such as profit sharing or what happens if a partner dies or retires from the business as the Partnership Act 1890 does not cover many of these issues directly and so disagreement may result in very costly litigation. It is important to remember that every partner is an agent of the others and may, on behalf of the partnership, enter contracts, incur debts and dispose of partnership property in the ordinary course of the partnership business. It is therefore vital that these matters are dealt with in a formal dental partnership agreement.
